| The Purpose
Partner Caregivers is a division of Jendee Cares LLC. The mission of Partner Caregivers is to create a safe, supportive place for partner caregivers. The primary focus of Partner Caregivers is for gay/lesbian/bisexual/transgender couples but anyone who is supportive of gay/lesbian/bisexual/transgender couples is welcome to join. This is being offered as a free service to everyone that wants to use it.
Terms of Use
Partner Caregivers is operated by Jendee Cares LLC. Throughout this document Partner Caregivers may also be referred to as “Jendee Cares”, "we" or "partnercaregivers.com". Partner Caregivers is offered subject to your acceptance without modification of any of the terms and conditions contained herein. These terms and conditions are considered an offer by partnercaregivers.com and acceptance is limited to these terms.
Please read this Terms of Use carefully before signing up and using partnercaregivers.com. By signing up you acknowledge that you have read, understand and agree to these terms of use. If we modify or replace any part of this Terms of Use, you will be sent an email stating the changes so that you can decide if you want to continue using partnercaregivers.com. Your continued use of partnercaregivers.com following the email of all changes to this Terms of Use constitutes acceptance of the changes. Jendee Cares may in the future offer new services and features through partnercaregivers.com and as such new features and/or services shall be subject to this Terms of Use. If you do not agree to all these or any future terms of use then do not sign up for partnercaregivers.com.
Eligibility Requirements
Partner Caregivers is available to individuals who are at least 18 years old. It is primarily for gay/lesbian/bisexual/transgender individuals who are also a caregiver to their partner/spouse. Anyone is welcome as long as they are supportive of other individuals and respect their relationships. You may not have more than one active account, register for an account on behalf of an individual other than yourself, or register for an account on behalf of any group or company. You are also prohibited from selling, trading, or otherwise transferring your partnercaregivers.com account to another individual or any other entity.
User Conduct
If you create a profile on partnercaregivers.com it is your responsibility to maintain the security of your account and password. You are responsible for all activities that occur under your profile name.
The services provided by Partner Caregivers are available for personal, non-commercial use only. If you create a profile, comment on another member’s profile, post material to partnercaregivers.com, post links on partnercaregivers.com, or otherwise make material available to other members on partnercaregivers.com you are entirely responsible for the content of, and any harm resulting from, that information. That is the case regardless of whether the information in question is text, graphics, internet site, audio file, or video file. With this Terms of Use you guarantee that no information of any kind submitted through your profile or otherwise posted, transmitted, or shared by you on or through partnercaregivers.com will violate or infringe upon the rights of any third party. These rights include copyright, trademark, privacy, publicity or other personal or proprietary rights. You also guarantee that no information provided or shared by yourself on partnercaregivers.com contains libelous, defamatory or otherwise unlawful material.
Therefore any information whether you upload, post, transmit, share, store or otherwise make available on partnercaregivers.com you guarantee that:
- The information was created by yourself, was a personal experience you had, or that you have permission by the creator to post the information
- The information is not harmful, threatening, unlawful, defamatory, infringing, abusive, harassing, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable
- Any graphical, audio or video posts feature yourself or your friends, was taken by you or your friends, or is original art or animation created by you or your friends (with their permission)
- The information does not include unsolicited or unauthorized advertising, solicitations, promotional materials, junk mail, spam, or any other form of solicitation
- The information does not reveal any private information of any third party, including addresses, phone numbers, email addresses and credit card numbers; particularly that the information does not solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes
- The information does not intimidate or harass another member or any other third party;
- The information does not constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or otherwise creates liability or violate any local, state, or national law
- The information is not, in the opinion of Jendee Cares, objectionable, restricting or inhibiting any other person from using or enjoying partnercaregivers.com or may be exposing partnercaregivers.com or its users to any harm or liability of any type.
By submitting information to partnercaregivers.com on your own or other member’s profile or to other services of partnercaregivers.com, you understand that others will read your comments. You are not to copy or reproduce other’s comments or postings. All information that is posted by a member is considered to be the property of the member who posted it and can not be reproduced without that member’s permission. The exception to this is if a member posts an information link with a reference to the non-profit or other public link, this information remains the property of the non-profit or organization that originally published the information. If you delete information we will use reasonable efforts to remove it from partnercaregivers.com but you acknowledge that caching or references to the information may not be immediately removed from partnercaregivers.com.
Except for your own personal information legally posted to partnercaregivers.com, no information posted by Jendee Cares or Partner Caregivers may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without Jendee Cares written permission.
Furthermore, when using partnercaregivers.com’s services you must not:
- Use any of the services or partnercaregivers.com in any unlawful manner or in any other manner that could damage, disable, overburden or impair partnercaregivers.com;
- Apply any automated scripts, electronic or other means to harvest or collect email addresses or other contact information of partnercaregivers.com’s members or otherwise interact with Jendee Cares for the purposes of sending unsolicited emails or other unsolicited communications;
- Voluntarily provide false information or otherwise misrepresent yourself, particularly regarding your age or your affiliation with any person or entity;
- Impersonate any person or entity;
- Use or attempt to use another member's account without authorization from that member or partnercaregivers.com;
- Stalk or harass another member.
Without limiting any of those representations or warranties, partnercaregivers.com has the right to, in partnercaregivers.com’s sole discretion, (1) reformat, excerpt, or translate any materials submitted by its members, (2) refuse or remove any content that, in partnercaregivers.com’s reasonable opinion, violates any partnercaregivers.com policy or is in any way harmful or objectionable, or (3) terminate or deny access to and use of the partnercaregivers.com to any individual for any reason. You must immediately notify partnercaregivers.com of any unauthorized uses of your account or any other breaches of security. Partner Caregivers will not be liable for any actions or omissions by you including any damages or losses of any kind incurred as a result of such actions or omissions.
Responsibility of Website Visitors
Partner Caregivers will make attempts to review material posted to partnercaregivers.com but can not physically review everything that every member posts. Therefore partnercaregivers.com can not be responsible for each member’s information, content, use, or effects. By operating partnercaregivers.com, Jendee Cares does not represent or imply that it endorses the material each member posts, or that it believes such material to be accurate, useful or non-harmful. Member’s posts may contain content that is offensive, indecent, or otherwise objectionable but if deemed medical advice it will not be removed by partnercaregivers.com. Member’s post may also contain technical inaccuracies, typographical mistakes, and other errors. Partner Caregivers cannot guarantee the identity of any other users with whom you may interact in the course of using partnercaregivers.com services. Additionally, we cannot guarantee the authenticity of any information which members may provide about themselves or relationships they may describe. Partner Caregivers does not maintain any responsibility for any harm resulting from the use by members of partnercaregivers.com or from any downloading by members or visitors of partnercaregivers.com.
We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites to which partnercaregivers.com links and/or links to partnercaregivers.com. Any of the links that are owned by Jendee Cares will be clearly marked so that members will be aware of the links that are maintained by Jendee Cares. Jendee Cares does not have control over other websites, not marked as being owned by Jendee Cares, and is not responsible for their contents or their use. Jendee Cares does not represent or imply that it endorses every website or webpage that links from its site. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Partner Caregivers disclaims any responsibility for any harm or losses resulting from your use of non Jendee Cares websites.
Termination
Partner Caregivers may terminate your access to the member’s area of partnercaregivers.com at any time, with or without notice, with or without cause, including if we believe that you are under the age of 18. If you wish to terminate your partnercaregivers.com account (if you have one) you may simply discontinue using partnercaregivers.com.
Warranty Disclaimers
Partner Caregivers is provided on an “as is” basis. Partner Caregivers, its suppliers, and licensors hereby disclaim all warranties of any kind, express or implied, and non-infringement. Partner Caregivers cannot guarantee and does not promise any specific results from use of partnercaregivers.com and their services. Neither Jendee Cares nor its suppliers and licensors, makes any warranty that partnercaregivers.com will be accurate, complete, reliable, current and error free or that access thereto will be continuous or uninterrupted. You understand that you access, download from, or otherwise obtain content or services through partnercaregivers.com at your own discretion and risk. No advice or information, whether oral or written, obtained by you from partnercaregivers.com shall create any warranty or guarantee.
Limitation of Liability
In no event will partnercaregivers.com, or its suppliers or licensors, be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (1) any special, incidental or consequential damages; (2) the cost of procurement or substitute products or services; or (3) for interruption of use or loss or corruption of data. Partner Caregivers shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
General Representation and Warranty
You represent and warrant that (1) your use of partnercaregivers.com will be in strict accordance with the Partner Caregivers Terms of Use and with all applicable laws and regulations (including without limitation any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, and including all applicable laws regarding the transmission of technical data exported from the country in which you reside) and (2) your use of partnercaregivers.com will not infringe or misappropriate the intellectual property rights of any third party.
Indemnification
You agree to indemnify and hold harmless Jendee Cares, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of or in connection with any information you post or share on or through partnercaregivers.com, your use of the services on partnercaregivers.com, your conduct in connection with the services on partnercaregivers.com or with other members of Partner Caregivers, or any violation of this Terms of Use or of any law or the rights of any third party.
Miscellaneous
This Agreement constitutes the entire agreement between partnercaregivers.com and you concerning the subject matter hereof. It may only be modified by the posting of a revised version on partnercaregivers.com. Revisions will also be emailed to all members so that everyone is aware of the revision.
Submissions
You understand and agree that any comments, questions, suggestions, ideas, or other feedback about the services on partnercaregivers.com, Partner Caregivers, or Jendee Cares provided by you to Jendee Cares are non-confidential and shall become the sole property of partnercaregivers.com with Jendee Cares owning exclusive rights, including all intellectual property rights. Jendee Cares shall be entitled to the unrestricted use and distribution of such submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
General Information
Partner Caregivers, partnercaregivers.com, Jendee Cares and the Jendee Cares logo are the property of Jendee Cares LLC. You agree not to display or use these trademarks in any manner without Jendee Cares LLC prior, written permission.
The section titles of this Agreement are displayed for convenience only and have no legal effect
